Terms of Service

1. Agreeing to these terms

EdCreate.com ("EdCreate", "we", "us") lets teachers create educational activities (quiz games, tests, flashcards, word games and more) and share them with their students. By using the site, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use EdCreate.

We communicate with you electronically, through the site and by email, and you agree that those communications meet any requirement that they be in writing.

2. Who can use EdCreate

Accounts are for adults. You must be at least 18 to create an account. Accounts are meant for teachers, tutors, parents and others who make activities for learners.

Students don't create accounts. They open their teacher's activities with a class login, or with a link the teacher shares, and use EdCreate under the supervision and with the permission of their teacher, school or parent.

3. Your account

• Give accurate information when you sign up, and keep your email address current so you can reset your password.
• Keep your password private. You're responsible for what happens under your account. Tell us right away at support@edcreate.com if you think someone else has used it.
• If you sign up with an email and password, you need to confirm your email before you can log in. Sign-ups that are never confirmed are deleted after 30 days.
• If you sign in with Google, your Google account is used to log you in; your use of Google is covered by Google's terms.
• After repeated wrong passwords, an account can't log in for a short time, to protect it from guessing.
• To help with a problem you report, or to keep the service running safely, EdCreate staff can view and act within an account. This access is limited to staff and is logged.
• Your account is for you. Don't share it or transfer it to someone else.

4. Using EdCreate with students

If you use EdCreate with students, you agree that:

• You have the authority to do so, including any permission your school, district or students' parents require. When students under 13 use EdCreate, you consent on behalf of their parents for this educational use, as described in our Privacy Policy, or you get parents' consent yourself.
• You'll ask students to enter only what's needed on tests: a first name or a student ID is enough.
• You won't put students' personal information in activities, class names or class page text.
• You'll review test results, and delete them when you no longer need them.

5. What's public

EdCreate is built for easy sharing, so these are visible to anyone who has the class login or a link, or who finds them using Search, and your activities can also appear in search engines such as Google:

• your class pages, including class names and class page text;
• your activities and everything in them;
• your first and last name, shown as the creator.

Activities can also be embedded on other websites. Tests are kept out of search engines, so the people taking them are the ones you share them with, and you can keep a whole class out of search engines in its settings. Students' test answers and scores are not public: only the teacher who made the test can see them.

6. Your content

You keep ownership of the activities, text and images you create or upload ("your content"). So that we can run EdCreate, you give us a worldwide, non-exclusive, royalty-free permission to store, copy, display, format and share your content as part of the service, including showing it on class pages, in Search, in embeds, and to the students and others you share it with. This permission ends when your content is deleted, except for copies kept in backups for a limited time.

You're responsible for your content. You confirm that you have the rights to everything you upload, including images, and that it doesn't break the law or anyone's rights. We may remove content, or suspend an account, if we believe it breaks these terms. We aren't obliged to review content, but we may.

If you believe content on EdCreate infringes your copyright, email support@edcreate.com with the page's address and the work it copies.

If you send us ideas or suggestions, we may use them without any obligation to you.

7. Acceptable use

Don't use EdCreate to:

• break the law, or harass, threaten or harm anyone;
• post content that is hateful, obscene, violent, or inappropriate for students;
• post anyone's private or personal information;
• impersonate someone, or misrepresent who you are;
• send spam or advertising;
• access, or try to access, accounts, data or parts of the site you're not meant to;
• upload viruses or harmful code, or probe, scan or test the site's security without our written permission;
• overload or disrupt the site, including with automated tools, scraping or excessive requests.

8. EdCreate's content and software

The EdCreate site, software, design, logos and the content we create are owned by EdCreate or its licensors and protected by law. We give you a personal, non-exclusive, non-transferable, revocable permission to use the site as these terms allow. Don't copy, modify, sell or reverse engineer the site or its software, or remove copyright or other notices, except where the law allows it.

9. The service, ads and changes

• EdCreate is free and supported by advertising. Ads appear on teacher pages and public pages. They never appear on the pages students use: class pages, activities, tests and the class login page.
• We may add, change or remove features, and may limit or stop the service, at any time.
• We work to keep EdCreate available and your content safe, but we can't promise the site will always be available or free of errors, or that content will never be lost. Keep your own copy of anything important.

10. Other companies' services

Some features use other companies' services: Google (sign-in, the "I'm not a robot" check on the contact form, and ads), Google Classroom and Microsoft Teams (when you share a link there), and the websites your activities or class pages link to or are embedded in. Those services are covered by their own terms and policies, and we aren't responsible for them.

11. Ending your use

You can stop using EdCreate at any time. To delete your account and everything in it, use Delete my account on your profile page, or email support@edcreate.com from your account's email address. Deleting is permanent; copies in our backups are replaced over time.

We may suspend or end your access, or remove your content, if you break these terms, if required by law, or to protect EdCreate, its users or others. Sections 6 (the parts about your responsibility), 8, 12, 13 and 14 continue to apply after your use ends.

12. Disclaimers and limitation of liability

EDCREATE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT CONTENT ON IT, INCLUDING CONTENT CREATED BY OTHER USERS, IS ACCURATE.

TO THE FULLEST EXTENT PERMITTED BY LAW, EDCREATE AND ITS OWNERS, SUPPLIERS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, USE OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE.

Some places don't allow some of these exclusions or limits, so they may not all apply to you. If you're unhappy with EdCreate or these terms, your remedy is to stop using it.

13. Indemnification

You agree to defend and hold harmless EdCreate and its owners and service providers from claims, losses and costs (including reasonable attorneys' fees) that arise from your content, your use of the site, or your breaking these terms or the law.

14. Governing law

These terms are governed by the laws of the State of Nebraska, USA, without regard to its conflict-of-law rules. Any dispute about EdCreate or these terms will be brought in the state or federal courts located in Nebraska, and you and we consent to their jurisdiction. If you use EdCreate from outside the USA, you're responsible for following your local laws.

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms, we haven't given up the right to do so later. These terms and the Privacy Policy are the whole agreement between you and EdCreate about the site.

15. Changes to these terms

We may update these terms. When we do, we'll change the date at the top; for important changes we'll also tell account holders by email or on the site when they take effect. Using EdCreate after a change means you accept the updated terms.
